These Terms and Conditions ("Terms") govern your use of Voyly - AI Guide (the "App") and related services (the "Service") provided by 2026 Code Platform, Unipessoal LDA ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old to use the Service. By using it, you confirm that you meet this requirement and that you have the legal capacity to enter into these Terms.
2. The Service
The App provides AI-assisted, voice-guided tours. Using your microphone and precise location, the App connects you to a third-party AI voice assistant (provided by OpenAI, Google/Gemini, and/or others) that guides you and answers questions in real time.
3. Accounts
You may need an account to use the Service. You are responsible for keeping your credentials secure and for activity under your account. Notify us promptly of any unauthorised use.
4. Important AI and safety disclaimer
The voice assistant is powered by automated AI systems and can be inaccurate, incomplete, or misleading.
- The guidance is provided for informational and entertainment purposes only and is not professional advice (including navigational, safety, medical, legal, or emergency advice).
- Do not rely on the assistant for navigation safety, emergencies, or decisions affecting your physical safety. Always remain aware of your surroundings, traffic, and local conditions.
- You are solely responsible for your own safety while using a guided tour.
5. Acceptable use
You agree not to: use the Service unlawfully; attempt to reverse-engineer, disrupt, or overload the Service; misuse the voice assistant to generate unlawful, harmful, or abusive content; or infringe others' rights.
6. Purchases (In-App Purchase Terms)
The App offers in-app purchases of guided-tour seconds. The following terms apply to those purchases and form part of these Terms. A plain-language summary is shown to you on the purchase screen before you buy.
6.1 What you are buying. The App sells guided-tour seconds — a quantity of talk time, measured in seconds (a "Tour-Time Credit"), that you use during live guided-tour calls with the AI guide. Each purchase is a one-time, consumable digital product. It is not a subscription and nothing renews automatically.
6.2 How purchases work. Purchases are made through the Apple App Store and processed by Apple using your Apple account payment method. The price, the number of seconds, and what is included are shown to you on the purchase screen before you confirm. By confirming, you agree to be charged. Prices include applicable taxes where required and may vary by region.
6.3 How seconds are used. Tour-Time Credit is consumed only while you are connected on a live call with the AI guide. The timer starts when the guided-tour call connects and stops when the call ends; time spent outside a call does not consume seconds. When your available seconds reach zero, guided tours stop until you purchase more. Your remaining seconds are shown in the App. Seconds are counted in whole seconds, rounded down in your favour: the number of seconds you purchase is the minimum provided, and the actual talk time available is typically slightly greater. You are not charged for seconds lost to a connection interruption that is detected on our servers.
6.4 Expiry of unused seconds ("burn"). Seconds expire 6 months after the date of the purchase in which they were bought. Where you hold seconds from more than one purchase, each purchase expires 6 months after its own purchase date, and your earliest-purchased seconds are used first (these are also the soonest to expire). After expiry, unused seconds are removed and cannot be recovered or refunded, except where a refund is required by applicable consumer-protection law. This expiry is disclosed on the purchase screen before you buy. 6.5 Refunds and consumer rights. Refunds for App Store purchases are generally handled by Apple under Apple's policies. EU/UK consumers may have a statutory right of withdrawal for digital purchases; where you ask us to begin supplying the seconds immediately and acknowledge that you lose the right of withdrawal once supply begins, the right may not apply. 6.6 No transfer. Tour-Time Credit is personal to your account, has no cash value, and cannot be transferred, sold, or exchanged.
6.7 Changes to pricing and products. We may change prices and products offered. Changes do not affect seconds already purchased. Material changes will be disclosed before they apply to new purchases.
7. Third-party services
The Service relies on third-party providers (AI providers, LiveKit, Google Firebase/Cloud, Apple). Your use may be subject to their terms, and we are not responsible for their services. See the Privacy Policy for how data is shared with them.
8. Intellectual property
We and our licensors own all rights in the App and its content (excluding your own content and third-party content). We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms.
9. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate. Nothing in these Terms excludes liability that cannot be excluded under applicable law (including mandatory consumer-protection and statutory rights, e.g. under German and EU law).
10. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for loss arising from your reliance on AI-generated guidance. Nothing limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited by law. [Portuguese law note: mandatory liability (e.g. for intent and gross negligence) cannot be excluded, and the unfair-contract-terms regime (Decreto-Lei n.º 446/85) limits exclusions of liability — confirm wording with counsel.]
11. Termination
We may suspend or terminate your access if you breach these Terms or for legitimate operational/legal reasons. You may stop using the Service and close your account at any time. Sections that by their nature should survive (e.g. IP, disclaimers, liability) survive termination.
12. Changes to these Terms
We may modify these Terms. For material changes we will notify you and require you to re-accept before continuing to use the Service. The version and date above will be updated. Non-material changes take effect on posting.
13. Governing law and jurisdiction
These Terms are governed by the laws of Portugal, without prejudice to mandatory consumer-protection rules of your country of residence. [Confirm jurisdiction/venue clause with counsel — consumer venue rules differ across EU/UK/US.]
14. Apple App Store — additional terms
Where you obtain the App from the Apple App Store, the following apply:
- These Terms are between you and 2026 Code Platform, Unipessoal LDA only, not Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- Apple is not responsible for any product warranties, claims, or third-party IP claims relating to the App; these are our responsibility to the extent required by law.
- Apple and its subsidiaries are third-party beneficiaries of these Terms (including the purchase terms in Section 6) and may enforce them against you.
- You confirm you are not located in an embargoed country or on a prohibited-parties list, as required by Apple.
